Improved For Profit
People who alter or destroy works of art and our cultural heritage for profit or as an exercise of power are barbarians, and if the laws of the United States continue to condone this behavior, history will surely classify us as a barbaric society.
These current defacements are just the beginning. Today, engineers with their computers can add color to black-and-white movies, change the soundtrack, speed up the pace, and add or subtract material to the philosophical tastes of the copyright holder. Tomorrow, more advanced technology will be able to replace actors with “fresher faces,” or alter dialogue and change the movement of the actor’s lips to match. It will soon be possible to create a new “original” negative with whatever changes or alterations the copyright holder of the moment desires. The copyright holders, so far, have not been completely diligent in preserving the original negatives of films they control. In order to reconstruct old negatives, many archivists have had to go to Eastern bloc countries where American films have been better preserved.
In the future it will become even easier for old negatives to become lost and be “replaced” by new altered negatives. This would be a great loss to our society. Our cultural history must not be allowed to be rewritten.
There is nothing to stop American films, records, books, and paintings from being sold to a foreign entity or egotistical gangsters and having them change our cultural heritage to suit their personal taste.
I accuse the companies and groups, who say that American law is sufficient, of misleading the Congress and the People for their own economic self-interest.
I accuse the corporations, who oppose the moral rights of the artist, of being dishonest and insensitive to American cultural heritage and of being interested only in their quarterly bottom line, and not in the long-term interest of the Nation.
The public’s interest is ultimately dominant over all other interests. And the proof of that is that even a copyright law only permits the creators and their estate a limited amount of time to enjoy the economic fruits of that work.
There are those who say American law is sufficient. That’s an outrage! It’s not sufficient! If it were sufficient, why would I be here? Why would John Houston have been so studiously ignored when he protested the colorization of The Maltese Falcon? Why are films cut up and butchered?
I hope you have the courage to lead America in acknowledging the importance of American art to the human race, and accord the proper protection for the creators of that art–as it is accorded them in much of the rest of the world communities.”

Empire State Of Fuck You
The New York City Council approved zoning and land use changes today to pave the way for a 1,190-foot tower at 15 Penn Plaza, and the owner of the Empire State Building ain't happy.The project is still in the planning stages by developer Vornado Realty Trust, who have no date for its construction and has yet to sign a major commercial tenant. The landmark's owner, Anthony Malkin, called it an "assault on New York City and its iconography." He left out, "and on my hugely profitable investment." Council members voted overwhelmingly in favor of the project, stating New York City and its world-famous skyline cannot afford to be frozen in time and must embrace new investments. "We can't make decisions based on one building...the city has to grow, and it's going to continue to grow." And besides, they're already down two building from 2001.
Mayor Michael Bloomberg also backed the project this week, dismissing Malkin's argument as delusional. "Anybody that builds a building in New York City changes its skyline — we don't have to run around to every other owner and apologize. One guy owns a building, he'd like to have it be the only tall building — I'm sorry, that's not the real world."
Vornado needed the council's action to rezone the area to accommodate a more dense development than local ordinances allow. The developer also needed the city's approval for transit improvements that Vornado has promised to finance. Lawmakers were told at a hearing that wider rail platforms at nearby Penn Station, better access to subway lines and the reopening of an underground passage connecting nearby subway lines and commuter trains to New Jersey would be part of the project
Plans envision a 67-story office tower two blocks west of the Empire State Building, which stands 102 stories and 1,454 feet but has an 86th-floor observation deck about 1,050 feet above ground. Malkin had lobbied the council to cut the tower by one-third the proposed height. The Empire State Building was the city's tallest when it was completed in November 1930, and hosts more than 3.8 million visitors each year. On a clear day, they say the view stretches 80 miles, as far as Pennsylvania and Massachusetts.

On a nightly basis, The Daily Show makes some of the smartest analysis of current events with unparalleled wit and satire. I would like to discuss a matter with you that bothered me. Yesterday evening I entered your 6pm Brand Strategy class approximately 1 hour late. As I entered the room, you quickly dismissed me, saying that I would need to leave and come back to the next class. After speaking with several students who are taking your class, they explained that you have a policy stating that students who arrive more than 15 minutes late will not be admitted to class.
As of yesterday evening, I was interested in three different Monday night classes that all occurred simultaneously. In order to decide which class to select, my plan for the evening was to sample all three and see which one I like most. Since I had never taken your class, I was unaware of your class policy. I was disappointed that you dismissed me from class considering (1) there is no way I could have been aware of your policy and (2) considering that it was the first day of evening classes and I arrived 1 hour late (not a few minutes), it was more probable that my tardiness was due to my desire to sample different classes rather than sheer complacency.
I have already registered for another class but I just wanted to be open and provide my opinion on the matter.

Just so I've got this straight...you started in one class, left 15-20 minutes into it (stood up, walked out mid-lecture), went to another class (walked in 20 minutes late), left that class (again, presumably, in the middle of the lecture), and then came to my class. At that point (walking in an hour late) I asked you to come to the next class which "bothered" you.
Correct?
You state that, having not taken my class, it would be impossible to know our policy of not allowing people to walk in an hour late. Most risk analysis offers that in the face of substantial uncertainty, you opt for the more conservative path or hedge your bet (e.g., do not show up an hour late until you know the professor has an explicit policy for tolerating disrespectful behavior, check with the TA before class, etc.). I hope the lottery winner that is your recently crowned Monday evening Professor is teaching Judgement and Decision Making or Critical Thinking.
In addition, your logic effectively means you cannot be held accountable for any code of conduct before taking a class. For the record, we also have no stated policy against bursting into show tunes in the middle of class, urinating on desks or taking that revolutionary hair removal system for a spin. However, xxxx, there is a baseline level of decorum (i.e., manners) that we expect of grown men and women who the admissions department have deemed tomorrow's business leaders.
xxxx, let me be more serious for a moment. I do not know you, will not know you and have no real affinity or animosity for you. You are an anonymous student who is now regretting the send button on his laptop. It's with this context I hope you register pause...REAL pause xxxx and take to heart what I am about to tell you:

Getting a good job, working long hours, keeping your skills relevant, navigating the politics of an organization, finding a live/work balance...these are all really hard, xxxx. In contrast, respecting institutions, having manners, demonstrating a level of humility...these are all (relatively) easy. Get the easy stuff right xxxx. In and of themselves they will not make you successful. However, not possessing them will hold you back and you will not achieve your potential which, by virtue of you being admitted to Stern, you must have in spades. It's not too late xxxx...

The Battle For North America Weekend
Best of the week: The most recent installment of "Sarah Palin gets mad at some comment made about her" lands on the “Family Guy” doorstep. If you're like me and haven't watched the show for years because it's not as funny anymore, the deal is last week's show featured a character with Down syndrome who said, “My dad’s an accountant, and my mom’s the former governor of Alaska.” (Watch it here.)Naturally, Palin got all pissy about someone talking about her retard baby Trig, because being sensitive about Down syndrome is as current as "Life Goes On" episodes. But the story finally gets interesting when Andrea Fay Friedman, the actress with Down syndrome who delivered the line in question, wrote an email to several different news outlets addressing the controversy:
I guess former Governor Palin does not have a sense of humor. I thought the line “I am the daughter of the former governor of Alaska” was very funny. I think the word is “sarcasm.” In my family we think laughing is good. My parents raised me to have a sense of humor and to live a normal life. My mother did not carry me around under her arm like a loaf of French bread the way former Governor Palin carries her son Trig around looking for sympathy and votes.

In the face of controversy with Italian-American groups, Snooki and JWoww have finally admitted that they're both not even really Italian. Nicole "Snooki" Polizzi (at least that sounds Italian) and Jenni "JWoww" Farley (that does not) came clean on Fox's Strategy Room. J-Woww says she's Spanish and Irish, while Snooki is Chilean.
The MTV reality show was slammed in the media for perpetuating "negative stereotypes", which apparently they are doing if their cast isn't genuinely Italian. It's bad enough that "reality" shows are cast to create conflicts, edited to make events seem more dramatic, and have writers. Perhaps they ought to be a little more honest in what they call the shows...here's a list of aptly renamed ones.

That's the message from the founders of Please Rob Me, a website launched on this week that illustrates just how easy it is to rob people blind on the basis of the information they're posting on the Web. If assholes like them are aggrigating the information for people to find.
The site uses streams of data from Foursquare, an location-based social network that is based on a game-like premise. People use smart phones or laptops to "check in" to a location, recording their position on a map for friends using the service to see. The more often you check in, the better your chances of being declared the mayor of a particular location, be it a restaurant, bar, office or even your own home (that's exciting, being the mayor of my house). The problem comes when users also post these locations to Twitter.
"We saw people checking in at their home addresses, or even worse, those of their friends and family," says Boy van Amstel says, one of the founders of Please Rob Me. Dude, your name is Boy, and your last name is a beer - this whole thing is irrelivant.
But the trouble isn't having a name that makes people want to kick your ass even if they've never met you, its that they monitor the latest posts of users sharing their locations and rebroadcast it. That's not a warning, that's being an accomplice. And a dick. What's the matter, Boy? Is that more fun that putting signs on cars in the parking lot when their windows are open or have doors unlocked so thaey are easier to steal?
Also: An 87-year-old WWII veteran named Robert Leeder recently suffered a stroke that paralyzed half his body and forced him to move into a nursing home. When his son Andre called DirecTV to cancel Robert’s service, DirecTV charged him an extra $400 for terminating the contract early. Andre emailed DirecTV, explained his father’s failing health, offered to provide medical records as proof, and requested that he be credited the $400 they charged. That’s when DirecTV politely told him to fuck off:
I’m sorry to hear about your father’s current health condition. I understand your concern with regard to the early cancellation fee…Since he canceled his service or did not maintain the minimum programming requirements, his account was charged with an early cancellation fee of $400. We feel this fee is valid and we are unable to waive it.
The story, thankfully, has a happy ending: Andre’s wife took to Facebook, where a groundswell of rage and enmity towards DirecTV helped the corporation realize, hey, maybe this $400 isn’t totally worth it. And people wonder why I haven't had cable for years...
And: Frankie Muniz, who played the titular character in the early 2000's sitcom "Malcolm in the Middle," left Hollywood to become a professional race car driver. That was as successfuls as being iceberg spotter on the Titanic.
Now he's looking to add "rock star" to his resume, drumming for the unsigned (and for good reason) act You Hang Up. "This is something I have always wanted in my life, and I'm thrilled to be associated with such a great group of guys!" Muniz wrote on his MySpace page (ironically named franiemunizracing) after joining the band in late December.
What a bunch of horseshit. Example: Muniz tweeted, "My band and I had a secret show last night and it was INSANE! The place was PACKED and we killed it! It was our first show ever!" Um, question...how did a band play a secret show - their first ever - and pack the house? Secret show and packed house seem at odds with first show.
You Hang Up's Myspace biography reads:
"Obviously a band can't get very far without a drummer, so after a few online and text messages between Frankie Muniz (drums) and Aaron [lead singer], regarding the music, the band met up with Frankie to talk about connecting the vision of You Hang Up with Frankie's long-time passion for drumming and music. Frankie moved to Arizona in 2008 to take a break from acting and pursue a professional career in racing, but has now become a permanent fixture of You Hang Up. Between Frankie's incredible drumming skills and his passion for music in general, he adds a flavor to You Hang Up that could not blend better with the group."
That flavor? Attention that you never had before because you were three nobodys without your D-rate celeb bandmate. Muniz said in a 2004 interview that he learned to "pound the skins from Zac Hanson" (as in 'MMMBop' Hanson). That sounds more like a gay reference than anything, and doesn't scream rock cred. Sobbing and sniffling like the lying bitch he is, Mark McGwire finally answered the steroid question.Ending more than a decade of denials and evasion, McGwire admitted what many had suspected for so long — that steroids and human growth hormone helped make him a home run king.
"The toughest thing is my wife, my parents, close friends have had no idea that I hid it from them all this time," he said in an emotional, 20-minute interview. Really? Because it was pretty clear to everyone else. McGwire apologized and said he used steroids and human growth hormone on and off for a decade, starting before the 1990 season and including the year he broke Roger Maris' single-season home run record in 1998.
"I wish I had never touched steroids," McGwire said. "It was foolish and it was a mistake."
He had mostly disappeared since his infamous testimony before a congressional committee in March 2005, when he said, "I'm not here to talk about the past." He had been in self-imposed exile from public view, an object of ridicule for refusing to answer the questions. Once he was hired by the Cardinals in October to be their hitting coach, however, he knew he had to say something before the start of spring training in mid-February.
McGwire even understands why the Maris family now believes that Maris' 61 homers in 1961 should be considered authentic record. His record of 70 home runs in 1998 was surpassed by Barry Bonds' 73 homers in 2001, the year of McGwire's retirement and the apex of the Steroids Era. Bonds himself has denied knowingly using illegal drugs but has been indicted on charges he made false statements to a federal grand jury and obstructed justice.
He said he first used steroids between the 1989 and 1990 seasons, after helping the Oakland Athletics to a World Series He said he returned to steroids after the 1993 season, when he missed all but 27 games with a mysterious heel injury, after being told steroids might speed his recovery. "I did this for health purposes. There's no way I did this for any type of strength purposes," he said, pointing out the medical, healing power of steroids. After being confronted by the AP during the home run streak in 1998, McGwire admitted using androstenedione, a steroid precursor that was then legally available and didn't become a controlled substance until 2004.
Baseball and its players didn't agree to ban steroids until a year after his retirement. McGwire wasn't sure whether his use of performance-enhancing drugs contributed to some of the injuries that led to his retirement, at age 38, in 2001. Now that McGwire has come clean, increased glare might fall on Sosa, who has denied using performing-enhancing drugs. McGwire's 70 homers in 1998 came in a compelling race with Sammy Sosa, who finished with 66. More than anything else, the home run spree revitalized baseball following the crippling strike that wiped out the 1994 World Series, and started and era of jacked up athletes ruining the national pastime.

Let's take a look at His Healthiness' medical records:• In September 1991, Ratzinger suffered a hemorrhagic stroke, which slightly impaired his eyesight temporarily. This was known to the Conclave that elected him Pope.
• In August 1992, on a vacation in the Alps, he fell and struck his head against a radiator.
• In May 2005, the Vatican revealed that he had subsequently suffered another mild stroke; it did not reveal when, other than that it had occurred between 2003 and 2005.
•France's Philippe Cardinal Barbarin further revealed that since the first stroke, Ratzinger had been suffering from a heart condition as a result of his age, and is currently on medication.
• In late November 2006, an unconfirmed rumor emerged that Pope Benedict had undergone an operation in preparation for an eventual bypass operation, and that the bronchitis suffered by the Pope has put undue pressure on the Pope's heart.
• On Friday July 17, 2009 Benedict was hospitalized after falling and breaking his right wrist while on vacation in the Alps. His injuries were reported to be minor.

Footage aired on Italy's RAI state TV showed a woman dressed in a red jumper vaulting over the wooden barriers and rushing the pope before being swarmed by bodyguards. The commotion occurred as the pope's procession was making its way toward the main altar, which came to a halt as security rushed to the trouble spot.

It was the second year in a row there was a security breach at the service. At the end of last year's Mass a woman who had jumped the barriers got close to the pope but was quickly blocked on the ground by security. This year, they were off their mark. The spokesman said it was not immediately known if the same woman was behind this incident, but it goes to show how incompetent church officials are as leaders if that woman from last year was free and she wasn't being monitored. Though it won't be shown to be the case, it's pathetic and desperate to make the suggestion it was a repeat attacker.

Krampusnacht Scheisse
Hopefully you got the phone call, Facebook update, or Twitter blast that there was trouble Saturday night, but many of you now know that the MAGNA Krampusnacht show did not quite go as planned.Checking randomly about 90 minute before the show, Rybot saw that there was no info for the bill up on the C.IA. website, and not having the venue promoting your event can be the first sign of a problem. Both Scaretoe and I were on our way to the venue, packed and ready. A few phone calls and it became clear that C.I.A. double booked the night.
Worse, the three other bands we booked onto the bill were getting hosed as well, and being told when they called the place that the night was not confirmed makes it apprear to be MAGNA's fault. See-Thru was kind enough to resend the communication to C.I.A. to refresh the owner's already failed memory. Judge for yourself and tell me if there's a gig booked or not?

So if MAGNA plays there again, well, that remains to be seen, but I don't know what benefit there would be anyway. We've been able to get prime nights and slots, and were setting up entire bills - what's the point of taking that responsibility on, and for what? Other than the apology and wry comment from the owner, "That's showbiz," what is there to gain? At least SHP was cool when they cut the set at The Viper Room in half and made good by working on an El Rey show, but what is C.I.A. going to do for MAGNA? And how to you get people show up there after they've been had once? Or the band?
In an attempt to salvage the night, we did a low volume set at Rybot's place a few hours later, which was a cool, intimate performance. Sorry if you got burned and we didn't catch you before you got there for the show (Scartoe and I stood in the rain for a half hour trying to catch you music hungry souls) - we'll try to make it up with another show soon. And we made a new fan and friend, who heard the band on Last.fm and came to check us out, not knowing he'd be kidnapped and brought to our tiny show. Looks like he had a good time.

Best of the week: Playing Doctor. An Arizona man who allegedly stole the identity of a San Francisco physician and posed as a doctor running a West Los Angeles sperm bank was arrested on suspicion of sexually assaulting two men.
Jeffrey Lynn Graybill (40) is accused of pretending to be "Dr. Robert Richardson" and soliciting sperm donors for the nonexistent Fertility Clinic of West Los Angeles. Investigators believe that there may be more than two dozen other victims in California and Arizona.
Although he had no medical license, Graybill allegedly advertised himself as a physician through internet listings on Craigslist and solicited potential clients, offering up to $4,000 monthly for sperm donations for "stem cell and other research."
Graybill, a property manager, had been trained as an emergency medical technician and used leftover medical equipment such as a stethoscope and blood pressure monitor to convince men that he was a doctor. He arranged to meet the first victim at the man's home, the second at an apartment Graybill managed. No, that's not a tip off... After Graybill failed to pay the men, one of them filed a complaint with Los Angeles police in June, triggering the investigation. Phoenix police also are investigating Graybill in connection with several similar assaults on men there. Prosecutors have charged Graybill with 11 felonies, including practicing medicine without certification, identity theft, sexual penetration and sexual battery by fraud.
Also: Seriously, WTF?The folks at the Wisconsin Tourism Federation couldn't possibly have seen how the interweb would change the lingo when it was established in 1979. But now that it's been pointed out, the lobbying coalition had to rethink using an acronym in the logo. To most anyone online, WTF has a different meaning these days...and probably not the kind of thing you want visitors thinking about when they think Wisconsin.
A quick check of the tourism board's website, and lo and behold, they've bowed to pressure and changed their name to the Tourism Federation of Wisconsin. The old logo lives on, however, at the Internet Archive. No word on the actions of the World Taekwando Federation.

The public information leaflets dropped by the C130 Hercules over a rural area came in boxes designed to open in mid-air, thereby scattering the leaflets over a wide range. But on June 23rd, they didn't. The box failed to break apart in mid-air and landed on top of the girl who died later in hospital. Oops! The British Ministry of Defence apologized for the actions of the Royal Air Force and is carrying out a full investigation. And here's a little history for you:
Leaflets have been used by militaries since at least the Napoleonic wars, when the British navy dropped them over France using kites. And they continue to be employed, because leaflets have some advantages over other media. Radio and TV are fine if the audience happen to be tuned in at the time, but printed matter is durable.
As the U.S. Army’s Psychological Operations Field Manual explains, "A printed leaflet has the advantage that it can be passed from person to person without the message being altered. It can convey a complex message which can be reinforced with pictures if the recipient is illiterate. And a leaflet can be hidden and read in private, and shared around with others."
