No Love For Jersey In The Big Apple
A New Jersey woman was stabbed in the face with a pen on a New York City subway train after she tried to stop a man from lighting a cigarette.
The assault occurred on a crowded No. 3 train near the Chambers Street station during Tuesday's morning rush.
Witnesses told the Daily News and the New York Post that an argument quickly escalated when Evelyn Seeger asked the man not to smoke. The witnesses say two riders were trying to restrain the man when he pulled out a pen and slashed Seeger's face.
Seeger, of Nutley, N.J., was treated at a hospital and released. Police charged the man with felony assault and criminal possession of a weapon.

Nothing good ever gets put in your mouth in church.Case in point - roughly 1300 parishioners of a Long Island church may have been exposed to hepatitis A when they received communion during services on Christmas day. Now there's a lump of coal for ya!
According to the Nassau County Department of Health, "a person involved in the Communion process has tested positive for hepatitis A". Theye did not specify whether the infected person was a priest, altar boy or Eucharistic minister, but does it matter? New York health officials are asking anyone who attended services at 10:30 a.m. and noon on Christmas day at Our Lady of Lourdes Church to return to the church Tuesday or Wednesday to receive a vaccination to fight off infection of the disease. And good luck trying to get volunteers for the Sunday school pot luck after this.
Hepatitis A can lead to flu-like symptoms such as severe nausea, diarrhea and fever, but isn't considered to be as deadly as hepatitis B and C, which can lead to chronic liver disease. Hep A is most commonly transmitted through food when an infected person fails to wash their hands before handling/preparing the food, particularly after they've gone to the bathroom.

Empire State Of Fuck You
The New York City Council approved zoning and land use changes today to pave the way for a 1,190-foot tower at 15 Penn Plaza, and the owner of the Empire State Building ain't happy.The project is still in the planning stages by developer Vornado Realty Trust, who have no date for its construction and has yet to sign a major commercial tenant. The landmark's owner, Anthony Malkin, called it an "assault on New York City and its iconography." He left out, "and on my hugely profitable investment." Council members voted overwhelmingly in favor of the project, stating New York City and its world-famous skyline cannot afford to be frozen in time and must embrace new investments. "We can't make decisions based on one building...the city has to grow, and it's going to continue to grow." And besides, they're already down two building from 2001.
Mayor Michael Bloomberg also backed the project this week, dismissing Malkin's argument as delusional. "Anybody that builds a building in New York City changes its skyline — we don't have to run around to every other owner and apologize. One guy owns a building, he'd like to have it be the only tall building — I'm sorry, that's not the real world."
Vornado needed the council's action to rezone the area to accommodate a more dense development than local ordinances allow. The developer also needed the city's approval for transit improvements that Vornado has promised to finance. Lawmakers were told at a hearing that wider rail platforms at nearby Penn Station, better access to subway lines and the reopening of an underground passage connecting nearby subway lines and commuter trains to New Jersey would be part of the project
Plans envision a 67-story office tower two blocks west of the Empire State Building, which stands 102 stories and 1,454 feet but has an 86th-floor observation deck about 1,050 feet above ground. Malkin had lobbied the council to cut the tower by one-third the proposed height. The Empire State Building was the city's tallest when it was completed in November 1930, and hosts more than 3.8 million visitors each year. On a clear day, they say the view stretches 80 miles, as far as Pennsylvania and Massachusetts.

According to the new Metro Wealth Index (created by consulting firm Capgemini), the New York Metropolitan area had 650,000 "high-net worth individuals", or people with $1 million or more in investible assets in 2009. That is almost 20% higher than the prior year, and helped the city top other cities in metro wealth (actually higher than the combined total of the next three wealthiest cities). All cities in the top 10 had strong growth, but Houston posted the the fastest growth, over 28%.

Let's not delve too deep into what "is" art, because ultimately, there can be no consensus. But fortunate New Yorkers can mark themselves down for another +1 on the self-importance scale as they are the debut U.S. stop for a worldwide tour of an "art installation" of 50 pianos.For two weeks, anyone can play tunes on pianos all over New York City, at famous landmarks like the Lincoln Center, the foot of the Brooklyn Bridge, the Staten Island ferry terminal and Central Park's bandshell. The concept, devised by British artist Luke Jerram, has put more than 130 pianos in parks, squares and bus stations since 2008. The cities effected by this blight include London, Sydney and Sao Paulo.
"There's going to be a huge amount of talent here," Jerram said. "The piano's actually a blank canvas for everyone's creativity, really, so I just hope that the city enjoys it." Oh, fuck you, dickhead. Go listen to some of the crackheads in Battery Park try their hand at a song and you'll see the void in skill.
The New York installation will be the largest in the project - there were only 30 pianos in London last year. Each of the 50 pianos to be installed throughout New York has its own attendants responsible for its care, unlocking the keyboard at 9 a.m. every day and deploying a heavy tarp if it rains.
The pianos were donated for the cause and have been painted and decorated by artists, which means in addition to hearing shitty music, there'll also be shitty decorations. The punishment will be delivered to 27 locations in Manhattan, 10 in Brooklyn, five in Queens and four each in Staten Island and the Bronx.
According to a website about the project, this jerk Jerram got the idea at his local coin-operated laundry, where he saw the same people there every weekend, but none of them talked to each other. He thought a piano might help bring people together in places like that. Hey asshole, it's not a pub, it's for cleaning stains off your sheets and underwear. People at a laundromat want to be anonymous and left alone. It's not a pick up joint or a place to make friends, and if you don't believe me, go to one in Harlem - with or without a piano - and see how long it take you to get stabbed after you approach a stranger.
Most pianos will be open for song until 10 p.m.

Of(f) Color, Or Black Like Me
Included in this year's guide, which was published in November and only finally sparked outrage, is a page titled "Of Color/Stylish Gifts." This first-time feature is described by the paper as "gifts created for and by people of color." After going virtually unnoticed by critics for a month, the guide's been widely slammed in the past week as a collection of "backhanded insults" which are "bordering on offensive" and "out of touch." You mean, this is like the shirts I had to see in the 90s that said "It's a black thing...you wouldn't understand"?
The "Of Color" section was compiled by African American (bona fide, yo) reporter Simone S. Oliver and was inside the "Style & Travel" section of the 2009 Gift Guide. Its contents include:
• "The Mocha Guide to Military Life," a book for African American women with family members serving in the military.
• A "Wise Latina" t-shirt, an obvious play on a controversial statement made by Sonia Sotomayor that became an issue during her Supreme Court confirmation hearings.
• "Hair Rules," a product for people of color with "problem hair."
• "Baby Jamz," which was created by Beyonce Knowles' father and sister, is "an interactive hip-hop and rhythm-based toy line."
Predictably, media watchdogs and Times critics have pounced on the paper for its publication of a gift recommendation list for non-whites. The conservative website Newsbusters blasted it as a guide for "race-based holiday shopping," while the liberal-leaning media gossip blog Gawker.com called it "a celebration of the racist assumption that 'people of color' are defined by their colors." Mediaite questioned the paper's editorial process in putting the guide together, saying that they were "utterly amazed it made it past the editing process," adding that they're "baffled why anyone felt the need to separate these gifts from the more generalized categories into which all these items fit, to one based on skin color."
New York Times spokeswoman Diane McNulty provided the following statement:
Our online gift guides are intended to offer holiday gift ideas for a wide variety of audiences and interests, with Times writers and editors making smart, informed choices that might appeal to those different audiences.
The "Of Color" guide, in the Style & Travel category, is in keeping with that philosophy, and with the efforts of a diverse Times staff to directly address minority readers with our content.
Of course, we expect our readers to use the guides however they choose, and we hope they'll find interesting ideas in many different categories. But we'll continue our effort to provide content that's relevant and appealing.

The 25-year-old chump, Raymond Martinez of the Bronx, and his brother were trying to dupe tourists into buying CDs along Broadway and 46th Street just before noon when he was recognized by a sergeant who runs a task force that monitors aggressive panhandling. An officer asked them for their tax identification, which allows peddlers to sell on the streets. But Martinez took off running, through to the Marriott Marquis hotel's passenger drop-off area.Sgt. Christopher Newsom pursued, and Martinez turned and fired with a Mac-10 9mm machine pistol that held 30 rounds; he got off two shots before it jammed. Punk sucker! The officer fired four times, striking the suspect in the chest and arms and killing him. "We're lucky the weapon jammed," said the Police Commissioner. Everybody but Martinez.
The commissioner added the shooting preliminarily appeared to be within department guidelines, which allow for deadly force when an officer's life is threatened.
Police say Martinez and his brother, who is in custody, were working a scam in which they would approach tourists, ask them their names, then write the names on the CDs and demand payment of $10. They claim the CDs are original work they've created, but it's unclear if that's true. In any case, what moron would want to give them $10 for a CD that someone wrote their name on?
The brothers had already been given a summons by officers this year for not having identification. Martinez had been wanted for assault in the Bronx. The gun he used in the shooting was reported stolen in Virgina on Oct. 28. He also had with him several business cards from gun dealers there, but it's not clear if he was also selling weapons.
NYPD spokesman Paul Browne said officers pay special attention to scams and panhandling during the holidays. Specialized units are set up in areas, including Times Square and Canal Street, where stolen goods, knockoffs and scams are prevalent. And sometime, they have to shoot those crooked motherfuckers so they don't rip anyone off.

Momma's Boy
Irene Prusik has been dead for six years. But in April, someone showed up at the Department of Motor Vehicles in Brooklyn to renew her driver's license. Her son, in drag!Thomas Parkin (49) was charged Wednesday in the plot to impersonate his deceased mother so he could collect $117,000 in government benefits. He and his accomplice, Mhilton Rimolo (sweet gay gigolo name), pleaded not guilty to grand larceny, criminal impersonation and other charges, which do not include playing bridge, attending high tea services, or enjoying hard candies.
Both men were ordered held on $1 million bail. District Attorney Charles Hynes said the scam was "unparalleled in its scope and brazenness." Apparently, he'd never seen Weekend At Bernie's or Psycho. Authorities claim that following his arrest, Parkin told them that because he held Prusik when she breathed her last breath, "I am my mother". Damn, that's a bad ass quote, considering the guy is wearing his mother's pantyhose!
Parkin, who lived with his mother (no surprise there), was accused of hatching the scheme after she passed away in 2003 at age 73. He concealed the death by falsifying her death certificate, then collected $52,000 from her $700-a-month Social Security checks over the next six years, prosecutors said. Authorities say Parkin also got another $65,000 in rent subsidies by falsely claiming he had a disability and that his mother was still alive and was his landlord. Parkin used his friend (that should be in quotes...the gay kind) Rimolo to pose as the mother's nephew when going to cash checks and do other business, prosecutors said. The ruse began to unravel amid a dispute over the mother's home, which was sold at foreclosure in 2003. Six years? That's a pretty slow unravel. Parkin challenged the purchase by suing the new owner on his mother's behalf so he wouldn't be evicted. As the property dispute dragged out, both sides eventually contacted the district attorney to accuse each other of fraud. By the time investigators arranged a meeting with the family in May, they already had proof Prusik was dead: a photo of her tombstone in a local cemetery. Oops. Maybe she should have been keep in the freezer.
The investigators played along as Parkin showed up for the interview "wearing a red cardigan, lipstick, manicured nails and breathing through an oxygen tank," prosecutors said. Wow, he must have thought he had them fooled at that point. It's really sad though...if you can fit into your mother's clothes, I mean.

Bastianich has paired Zeppelin's raw, nuanced, complex and high energy music with fine wine and italian food. The writer David Lynch and Mike Edison have joined the team to discuss the songs and the appropriate wine pairings. Led Zeppelin lends itself to wine; Hearty, robust reds match Page's raw riffs and Bonham's thunderous double bass pedal, while the band's lighter, more playful work calls for tamer, yet complex whites. On stage will be the live Zeppelin cover band Six Foot Nurse featuring special guest guitarist Scott Ian of the band Anthrax, all coming in from Los Angeles for the evening. This event was recently tested without the live band at the smaller restaurant Becco where it sold out instantly.
An example from the previous event: David Lynch - "We're pairing "The Song Remains the Same" with two crispy acidic, chalky, mouth-tingling whites. Think about the opening guitar riff, that jangling makes me think of the bubbles rising in a glass of Champagne. We really captured the spirit of these wines, the acidity, their raciness, the treble. Fail Like You Mean It
Sorry Scarlett, but Wisconsin's new state slogan is already inspiring something...and it's not exactly unanimous praise.Gov. Jim Doyle said Mothe state will use "Live Like You Mean It" to promote Wisconsin as a tourism and business destination, replacing the slogan "Life's So Good." I don't think that's what the advertising and creative types call "an improvement". Yes, that is a technical term. Additionally, motivational speakers, authors and even spirit maker Bacardi have already used the phrase in marketing campaigns.
Critics who aren't thrilled the state is adopting their slogan may oppose its attempt to get federal trademark protections on it or even take legal action. "They are not going to get a federal trademark. I just wanted to let them know that," said Ellyn Luros-Elson, with all the power of a dietitian who co-authored a 2006 book by that name. "It doesn't make sense the state is going to use something they know has already been put out there."
The state's brand manager, Sarah Klavas, said the Department of Tourism thoroughly vetted the phrase before introducing it and is confident there will be no trademark infringement. She said the state applied for a trademark with the U.S. Trademark and Patent Office and is awaiting approval. A legal review, which included hiring an outside firm, turned up no problems and she noted that multiple entities can use the same phrase as long as they are promoting different items. The Department of Tourism plans to use the new phrase in advertising campaigns and is encouraging other state agencies to follow suit.
"This is another tool we'll use to keep loyal visitors coming back, communicate why a business should relocate or expand here, and let talented employees know why they should choose Wisconsin," Doyle said. A University of Wisconsin-Madison law professor (naturally) said they doubt the state would have legal problems. As long as there is no risk that consumers will confuse the state's marketing with someone else's, the likelihood of problems is low. Given the term's widespread use, another UW-Madison professor was surprised the state was seeking trademark protection, since a quick web search revealed broad use in the public domain.
At least five trademarks covering the term's use are active, according to a U.S. Trademark and Patent Office database. Companies are using the term to promote real estate, clothing, and other merchandise; one headed by retired NFL great Bill "I ended the career of a teammate by punching him so hard in the face from my 'roid rage that it crushed his orbital bone" Romanowski deploys it to market dietary supplements and energy bars. Bacardi dropped the trademark in 2008 after using the term in its print, television and in-store advertising for years. The company has no plans to bring back the slogan, which is far more fitting a boozy night with sluts than an entire land mass, and does not oppose Wisconsin's use.
Others who use the term say it's premature to talk about potential legal action but aren't ruling it out. A lawyer in Kentucky registered the phrase as a trademark in 2007 for a local real estate developer who sells condominiums and student housing, and would "absolutely" be reviewing the state's plans. That's also the position of a personal development trainer from the New England area who uses the term as the title of her program, and palns to release an audio CD and a book using the slogan.

Big League Stew smartly called this $240 million worth of initials, and the largesse is kind of embarrassing. Think about it: that’s an 82 million dollar pitcher standing next to a 161 million dollar pitcher standing in a new $1.3 billion dollar stadium.In a related story, I found two dollars in change under my couch cushions. Hello, slice of pizza for lunch!
That’s not true, actually. It was just a joke. The truth is I have a futon because couches are way expensive. So I didn’t find any change at all. Who knows what I’ll have for lunch. Maybe this white bread is still good. Man, this got real depressing real fast.
